TESSIER (the «Merchant») manufactures, repairs, rents and sells equipment for sports activities, in particular for people with disabilities.

In these general terms and conditions of sale (the «T&Cs»):

  • Customer : any natural person or legal entity who purchases products on the Site;
  • Consumer : any Customer who is a natural person acting for purposes outside their professional activity;
  • Non-professional : any legal entity that does not act for professional purposes, in particular an association or a sports club;
  • Professional : any Customer acting for purposes falling within the scope of their commercial, industrial, craft, professional or agricultural activity, in particular a company or an establishment;
  • Products : the goods offered for sale on the Site.

2. Scope

These T&Cs apply to every sale of Products concluded on the Site. The Customer accepts them by ticking the box provided before confirming their order. They prevail over any other document, in particular the purchasing conditions of a Professional Customer, unless the Merchant agrees otherwise in writing.

The applicable version is the one in force on the date of the order. The Customer may save or print it at any time. The rental and repair of equipment are subject to separate conditions and are not governed by these T&Cs.

The provisions specific to Consumers (articles 9 and 10) do not apply to Professionals or Non-professionals, who are also subject to article 12. The statutory warranty against hidden defects under the Civil Code remains applicable to them.

3. Products

The essential characteristics of the Products are presented on each product page. Photographs and illustrations are as accurate as possible; slight differences in color or appearance cannot engage the Merchant's liability.

The Customer chooses the Products at their own responsibility, based on their needs, body type and practice. It is up to the Customer to seek advice before purchasing; the Merchant remains available to guide them. The Products must be used in accordance with their intended purpose, the instructions and the safety guidelines provided.

The Merchant never certifies that the Products meet any standards of a country other than France in which the Customer intends to use them. It is the Customer's responsibility to verify, where applicable, their approval in that country.

4. Prices

Prices are indicated in euros, including all taxes (incl. VAT), or excluding taxes (excl. VAT) depending on the legislation in force, and exclude delivery costs. Delivery costs are indicated before the order is confirmed.

The Merchant may change its prices at any time; the applicable price is the one displayed when the order is confirmed. In the event of an obvious pricing error (a derisory price or one unrelated to the value of the Product), the order may be cancelled and the Customer fully refunded.

5. Order

To place an order, the Customer:

  1. selects the Products and adds them to their cart;
  2. enters their contact details and chooses the delivery method;
  3. checks the order summary and corrects any errors;
  4. accepts the T&Cs by ticking the box provided;
  5. confirms their order by clicking the «Order with obligation to pay» button, then proceeds to payment.

The sale is concluded upon receipt of payment. The Merchant then sends the Customer an order confirmation by e-mail.

The Merchant may refuse or cancel an order for a legitimate reason, in particular:

unavailability of the Product, failure or refusal of payment, an unresolved dispute with the Customer, an order that is abnormal in quantity or suspected fraud, or an obvious pricing error. The Customer is informed and, where applicable, fully refunded.

6. Payment and retention of title

Payment is made online by bank card, via the secure provider PayPlug, with 3-D Secure authentication. Bank details are transmitted in encrypted form and are not stored by the Merchant.

The Products remain the property of the Merchant until the price has been paid in full. However, risk is transferred to the Customer under the conditions of article 8.

7. Availability

Products are offered while stocks last; stock levels are shown for information only on each product page. Products marked «Available to order» are not in stock: the estimated lead time is communicated to the Customer by e-mail.

If an ordered Product proves to be unavailable, the Merchant informs the Customer without delay. The Customer may then wait for the item to be restocked or cancel their order; they will be refunded within 14 days of cancellation.

8. Delivery, collection and transfer of risk

Home delivery. Products in stock are shipped within 3 business days of order confirmation, by the carrier chosen by the Merchant (Colissimo, UPS…). The estimated delivery time is shown before the order is confirmed. If no time is specified, delivery takes place no later than 30 days after the order. The Customer must provide an accurate delivery address that is served by the carrier; a return caused by an incorrect address will be invoiced to the Customer.

If the agreed deadline is exceeded, the Consumer may ask the Merchant to deliver within a reasonable additional period and, failing that, cancel the order and be refunded.

Collection from the workshop. The Customer may collect their order free of charge from TESSIER, Alpespace, 336 voie Thomas Edison, 73800 Sainte-Hélène-du-Lac, by appointment.

Upon receipt, the Customer is invited to check the condition of the parcel and to note any specific reservations on the delivery note, then to report any damage or missing product to the Merchant within 3 days, with photos. These steps help speed up the handling of their claim.

For the Consumer, the risk of loss or damage is transferred when they take physical possession of the Products. For the Professional and the Non-professional, it is transferred as soon as the Products are handed over to the carrier (article 12).

9. Right of withdrawal and returns

Period. The Consumer has 14 days from receipt of the Products to withdraw, without having to give a reason.

How to withdraw. The Consumer informs the Merchant of their decision before the period expires, by a clear statement sent to contact@tessier.sport or by post, stating their order number. They may use the form provided in the appendix, but are not required to.

Returning the Products. The Consumer returns the Products, complete and with their accessories, to TESSIER, Alpespace, 336 voie Thomas Edison, 73800 Sainte-Hélène-du-Lac, no later than 14 days after communicating their decision. Return costs are borne by the Consumer. For Products that, due to their nature or size, cannot normally be returned by post, the estimated return cost is indicated on the product page. The Merchant recommends tracked shipping and protective packaging separate from the original packaging.

Refund. The Merchant refunds all sums paid, including the initial delivery costs based on the standard delivery method, within 14 days of the decision to withdraw. The Merchant may defer this refund until the Products have been received or proof of their shipment is provided. The refund is made using the payment method used when placing the order.

Condition of the Products. The Consumer may handle the Products as they would in a store in order to check their nature, features and proper functioning. The Consumer is liable for any loss in value resulting from other handling, in particular use in real conditions, signs of wear, missing original labels or damaged original packaging. The amount refunded may be reduced proportionately.

Exchange. For clothing, the Merchant may offer an exchange, subject to available stock; return and second shipping costs are then borne by the Customer.

The right of withdrawal does not apply to Professionals or Non-professionals.

10. Legal guarantees and after-sales service

All Products benefit from the legal guarantees below, at no additional cost. To invoke them, the Customer contacts the Merchant at contact@tessier.sport, stating their order number and the defect found. Returns under these guarantees are paid for by the Merchant.

The guarantees do not cover defects resulting from normal wear and tear, impact, accident, poor maintenance, use not in accordance with the intended purpose or the instructions, or modification or repair carried out by a third party.

Legal guarantee of conformity and guarantee against hidden defects

The consumer has a period of two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer is only required to prove the existence of the lack of conformity, not the date it appeared.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the statutory guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee. If the consumer requests repair of the goods but the seller insists on replacement, the statutory guarantee of conformity is renewed for a period of two years from the date the goods are replaced.

The consumer may obtain a reduction of the purchase price while keeping the goods, or terminate the contract and receive a full refund upon return of the goods, if: 1° the trader refuses to repair or replace the goods; 2° the repair or replacement takes place after a period of thirty days; 3° the repair or replacement causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of collecting or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods; 4° the lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. In that case, the consumer is not required to first request repair or replacement of the goods. The consumer is not entitled to termination of the sale if the lack of conformity is minor.

Any period during which the goods are immobilized for repair or replacement suspends the guarantee that remained to run until the repaired goods are delivered.

The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code.

A seller who in bad faith obstructs the implementation of the statutory guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10 % of average annual turnover (Article L. 241-5 of the Consumer Code).

The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund upon return of the goods.

11. Liability

The Merchant is not liable for damage resulting from use of the Products that does not comply with their intended purpose, instructions or safety guidelines, from lack of maintenance, from modification of the Products, or from the Customer's failure to comply with applicable sports practice or homologation rules.

The Merchant is not liable for failure to perform its obligations in the event of force majeure within the meaning of Article 1218 of the Civil Code.

These limitations do not apply to personal injury or to the Merchant's gross negligence or intentional misconduct, and do not deprive the Consumer of the rights granted by law.

12. Provisions specific to Professionals and Non-professionals

The following provisions apply to Professionals and Non-professionals (clubs, associations) and prevail, for them, over the other articles of the T&Cs.

  • Transfer of risk: risk is transferred to the Customer as soon as the Products are handed over to the carrier. In the event of damage or missing items, the Customer must state precise reservations on the delivery note and confirm them to the carrier by registered letter within 3 days of receipt (Article L. 133-3 of the Commercial Code), with a copy to the Merchant.
  • Claims: apparent defects must be reported in writing within 8 days of receipt; failing this, the Products are deemed accepted.
  • Warranty: the Merchant's warranty is limited, at its option, to repair or replacement of Products found to be defective, for 12 months from delivery, without prejudice to the statutory guarantee against hidden defects owed to Non-professionals.
  • Liability: the Merchant's liability is limited to the amount of the order concerned. It is not liable for indirect damages, such as loss of business, loss of turnover or damage to reputation.
  • Late payment: for Professionals, any sum not paid by the due date automatically incurs penalties at a rate of three times the statutory interest rate, together with a fixed recovery cost allowance of €40 (Article L. 441-10 of the Commercial Code).
  • Jurisdiction: for Customers who are traders, any dispute falls within the exclusive jurisdiction of the Commercial Court of Chambéry, including in the event of multiple defendants or third-party warranty claims.

13. Personal data and intellectual property

The Customer's personal data is processed to manage their orders and the commercial relationship, in accordance with the Site's Privacy Policy.

The Customer may receive newsletters by e-mail unless they object by ticking the box provided when placing the order or, at any time, via the unsubscribe link included in every e-mail.

The texts, images, logos and trademarks appearing on the Site are protected by intellectual property law. Any reproduction, even partial, without the Merchant's written permission is prohibited.

14. Mediation, governing law and disputes

These T&Cs are governed by French law.

In the event of a problem, the Customer is invited to first contact the Merchant at contact@tessier.sport in order to seek an amicable solution.

Failing agreement, the Consumer may use, free of charge, the consumer mediator to whom the Merchant is subject. The Consumer must first have sent a written complaint to the Merchant.

Failing an amicable resolution, the Consumer may bring the matter, at their choice, before the court of the place where they resided when the contract was concluded or when the damaging event occurred, or any other competent court. Disputes with Business Customers are governed by article 12; for other Customers, in particular clubs and associations, the ordinary rules of jurisdiction apply.
